Los Altos Hills Civic Association Alert LAH School Redistricting Meeting December 7, 2006 at 4:00PM

County Committee for School District Organization Meeting Where: 1290 Ridder Park Drive, San Jose, CA 95131

Dear Los Altos Hills Civic Association member,

LAHCA has taken no official stand on redistricting, as we have not officially polled all of our members. However, none of our steering committee members support redistricting, as well as former mayors Bob Fenwick, Steve Finn, Toni Casey, and Emily Cheng.

Having served on the Los Altos Hills Council for 12 years and Mayor for three terms, my personal opinion is that redistricting is impractical, and would remove our option to attend excellent public schools such as Loyola, Blach, Terman, Nixon, Gunn, and others. Redistricting would not improve education for LAH kids but will only limit our choices.

Current laws prohibit a stand-alone K-8 district from feeding into a unified district such as PAUSD/Gunn.

Los Altos Hills has always outsourced our services as we are a small spread out semi-rural residential community. We have excellent education choices provided by top-rated LASD and PAUSD.

To form our separate school district would be a misstep and inconsistent with the founding fathers of our Town who stated that the goal of incorporation 50 years ago was limited government. Creating a school board bureaucracy when we have excellent schools to attend is not upholding the goals and traditions of our town.

Finally, a return of LAH neighborhood K-6 public education is already planned for August 2008 with the reopening of the Bullis-Purissima site.

3. Please see the attached text of the David Binder survey that asked LAH residents whether they supported redistricting LAH into a separate school district, but misleading them by stating that "Students currently enrolled in elementary schools could be permitted to continue attendance at their current schools." This is obviously untrue because if LAH formed its own school district, LAH residents would no longer have access to LASD and PAUSD schools. The poll results would have been quite different if respondents had been told that their educational choices would be restricted.

4. Also attached is the AGENDA for the important County Committee meeting where redistricting will be discussed.

LAH children need continued access to top-rated LASD and PAUSD schools. Redistricting would reduce choices, reduce property values, isolate LAH, and will not increase the quality of education. It is a terrible idea.

September 3, 2006 Alert (Vandalism)

On Sunday 8/27 vandals smashed the windows of a car parked in a driveway on Mora Drive at the intersection of Sun Hills.  There was no theft, just pure vandalism.  There was another incident at the end of July when two cars were similarly vandalized on Eloise Circle .  

It is suspected that the August 27 vandalism occurred as the result of an unauthorized party in the Waldorf School parking lot (corner of Eastbrook and Mora Drive ).  Beer bottles were found in the parking lot and several mailboxes in the area were also damaged.  The new superintendent of Waldorf School spoke with the Sheriff’s office and is going to have a chain installed to prevent access to the parking lot when the school is closed.  

If you see suspicious activity, please call the sheriff’s office right away.

From a home phone you can dial 911.  From a cell phone, call either 408-229-2311 or 408-299-3233.  These are both direct-dial emergency numbers that can also be used for non-emergency calls.  It is best not to make 911 calls on a cell phone since they are routed through the CHP in Vallejo and response can be delayed.

May 30, 2006 Alert (Armed Robbery)

On Tuesday, May 23, at around 9:30 PM, an armed man forced his way into a hillside home off Moody Road. It is believed that the intruder had stalked another resident of Los Altos Hills who owned a Ferrari and that he thought he was robbing the home of the Ferrari owner. After the intruder realized he was at the wrong home he simply took cash and costume jewelry and left the victims unharmed.

The masked gunman gained entry to the home by throwing small rocks up against the house to lure the homeowners outside. The gunman was lurking just outside the door and immediately accosted the homeowners at gunpoint, tied them up and robbed them. The couple managed to untie themselves and call 911 after the gunmen left the property. Although the Santa Clara County Sheriff's deputies were at the scene within 5 minutes and searched the hillside with sheriff's deputies, helicopter infrared cameras and searchlights, and tracking dog for several hours, the robber was not apprehended.

If anyone saw any suspicious characters in the vicinity of Moody Road that evening or if you have any information that could help apprehend this person, please contact the Santa Clara County Sheriff's Department.

February 25, 2006 Alert (Auto Burglaries)

 

To all LAH residents,

 

First, I would like to introduce myself.  I am Deputy Rob Rudden and I am currently assigned to your Town during the hours of 7am to 5 pm , Monday through Thursday.  I have been a Deputy for 8 years and have been with the County for 16 years.  I previously worked as a Corrections Officer at the County Jail .  As a Deputy, I have been previously assigned to East Side San Jose, Burbank district, County Parks , and Courts. 

 

Now let’s talk about what you as residents need to do to help us better serve you.  Recently there has been a rash of auto burglaries all around your neighborhoods.  Let me clarify something, these are not really auto burglaries, because the majority of all of these vehicles were left UNLOCKED!  Some even with the garage door open all night.  These crimes are taking place in the middle of the night.  Our night shift deputies are aware of these crimes, but they can't be on every street in a 10 hour shift.

 

I know you feel safe in your neighborhood, but to a thief, leaving your vehicles unlocked is an invitation for theft.

 

PREVENTION #1:  Lock all vehicles, day or night.

 

PREVENTION #2:  Get a motion light installed in your driveway, it may deter them from continuing onto your property.

 

I will try to keep all of you posted on criminal happenings and supply you with prevention tips.

January 5, 2006 Alert (Storm Cleanup)

The Los Altos Garbage Company will have collection vehicles located at three sites on Saturday January 7th and January 14th 2006 for the drop off of unlimited green waste and wood as a result of the recent storms.  All other debris will not be accepted.  Listed below are the collection sites that will be operating from 9 am - 2 pm on both collection days.

October 29, 2005 Alert (Cell Phone Coverage)

We have heard from several Los Altos Hills residents that are very concerned about the lack of good cell phone coverage in Los Altos Hills. We have also shown below a Verizon cell phone coverage map, showing the reception quality before and after the Westwind Barn tower is installed.

Also, here is a copy of the Town's staff report on Wireless Communications- Agenda item 11.1 Status Report.pdf. The Staff report includes a list of the cell phone tower sites currently in Town, a list of possible sites, information about cell phone RF safety, and letters/emails from various residents.

If you agree with the need for better cell phone coverage and if you support the Westwind Barn Tower, please contact our City Council members to voice your support. T he Tower was approved at the Planning Commission and is now going to the City Council for final approval.

There is an important Public Hearing on Cell Phone Coverage (and specifically Verizon's request to install a Cell phone tower at Westwind Barn) this coming Thursday 11/3 at 6:30 PM at Town Hall, 26379 Fremont Road.  Please attend, if you can. The City has also sent out a postcard notifying residents of this hearing.

Dear friends in Los Altos Hills,

As you know your cell phone coverage in Los Altos Hills is abysmal.

The cell phone carriers would like to put a few towers here to improve our service, but some residents don't want any cell towers anywhere near to where they live, and others in town are opposed to cell phones in general.

I believe the only way to improve the coverage situation is to work with the providers and strategically locate a few towers throughout town.  At the present time, a tower is proposed on town-owned land at Westwind Barn and it is the first attempt to get a tower at a higher elevation and a few miles west of 280.

This tower is critical if we ever hope to improve cell phone service in town.  I am one of the closest neighbors to this new proposed tower and fully support it.  However, a handful of vocal town residents showed up at the recent Planning Commission hearing for the tower application and objected to it, trying to de-rail its approval.  Fortunately a few other residents showed up in support of the application and the Planning Commission approved the new tower 3-1.

Now, however, on November 3rd the Town Council must make the final vote for this tower to be installed, and the opposition group is gathering momentum to try to block it using photos depicting an ugly tower at Westwind Barn.

My request to you is that you send an e-mail to the five Town Council members saying if you believe cell phone coverage in town needs to be improved, not only for normal convenience reasons, but also for emergency purposes in case of earthquakes or fires:

As a follow-up to our previous email alert, we are sending out this update. It includes responses from Craig Jones (one of our Councilmembers), responses from Eric Clow (Ad Hoc Planning Committee member), as well as reference source material on each issue, including proposed ordinance wording (if available), CC meeting minutes, Los Altos Town Crier and San Jose Mercury news articles, etc.

Many of you may not be aware of what is presently happening in our Town, including the following:

1. Our Town Council is poised to spend up to $3 million of Town funds to buy land for Bullis Charter School, which presently has only 74 LAH students in attendance.  The Council has not solicited any recommendation from the Town's Finance and Investment Committee, but only asked them how much money the Town could spend. The Los Altos Hills Civic Association believes that any Town expenditure of this magnitude and benefiting so few residents should be placed on the election ballot for a vote.

Craig Jones (Councilmember) Response:

"I don't know what "poised to spend" means. The only thing the City Council has done is endorse partnering with the Bullis Foundation to take advantage of $5.0mm of private donations given to help the Bullis Charter School relocate into LAH. We have allocated $12,000 for technical assistance. We have not allocated anything else. We have not yet had public hearings on the subject, let alone determined how the Town should be involved. We are interested in multi-purpose space, where the Town could get access to recreational facilities such as soccer fields and basketball courts. How the Town should be involved financially is very much a subject for further study, exploration and public hearing. If we can get an excellent public school in our town which has none, and at the same time gain recreational facilities, it would be foolhardy not to try to see how that might make sense."

2. The Environmental Design Committee is looking into limiting the maximum size of homes in LAH.  They have researched other Towns and will be making a presentation to the Town Council soon.

Craig Jones (Councilmember) Response:

"As you know, I asked the question during the campaign whether we should limit maximum house size. I have since seen many nuanced questions and problems with this including whether the land would just be further subdivided and even more densely developed. I prefer the energy conservation approach, but of course will listen to any specific proposals with an open mind."

3. The Open Space Committee is developing a new open space/conservation easement ordinance which would require that any area over 30% (16.7 degrees) slope be dedicated as open space easement at the time of site development.

Craig Jones (Councilmember) Response:

"I have not seen anything on this from the OSC, which means it has not come to the CC in any form."

Eric Clow (Vice Chair- Ad Hoc Planning Committee) Response:

"I have been told that the Open Space Ordinance that is being developed by the Open Space Committee is avoiding references to a 30% slope. That is good news, but I am still concerned that many in Town are asserting that the General Plan supports requiring Open Space easements (formerly known as conservation easements) for all property steeper that 30% (a 16.7 degree slope). The most recent draft I've seen of the LAH Open Space Ordinance (dated 8/14/05) makes this case pretty strongly (http://www.lahca.com/LAH%20OS%20Ordinance%202005-08-14.pdf). When I read it, I was skeptical, so I got out my copy of the General Plan and looked up the quote about "30% slopes" from the proposed Open Space Ordinance. Pages 14 & 15 of the General Plan http://www.lahca.com/General%20Plan%20pages%2014%20&%2015.pdf) contain this quote. Sure enough, in the paragraph immediately before the 30% section, the General Plan permits subdivisions with average slopes up to 50%! On the following page you can see that the "Open Space Conservation Areas" referred to in section 2 are actually mapped out on the Plan Diagram which resembles a wildlife corridors map and is mainly confined to the deep valleys around creeks in town. A very small percentage of the town was covered by the Open Space Conservation Areas and nearly all of it was protected already. The General Plan has always been ambiguous about the need for Open Space easements on slopes between 30% and 50% which is why, in the past, the Town has only required them where there is a clear conservation rationale for them.

Requirements to put all 30% sloped property into Open Space easements would rob property owners of the use of land which can be used for gardens, vineyards, paths, and many uses. For many homeowners, 80% or 90% or their land is over 30% (16.7 degree) slope. As you can see from http://www.lahca.com/Histogram%20LAH.pdf and http://www.lahca.com/Page%20size%20Percent%20Slope%20LAH.pdf, 16% of town land is involved (about 860 acres, worth hundreds of millions of dollars). This is a huge portion of the town's land and would have a big impact on many residents over time. My hope is that the Town conducts a full debate of this new policy direction with full recognition of the magnitude of the taking of property rights that is contemplated here. I am confident that when the facts are made clear, our Council will pull away from these proposals to automatically place land steeper than 30% in conservation easements, and will return to the former policy of only requiring easements where there is a clear conservation rationale."

4. The Council has hired a wildlife corridor expert to review and map the Town's wildlife corridors and help make recommendations on how to protect them with some new ordinances, including allowing only open fencing to be used in such areas.

Craig Jones (Councilmember) Response:

"It is true we have hired a wildlife biologist so we can get some hard data, as contrasted to anecdotal observations from neighbors about the wildlife migrations through LAH so we can be sensitive as to how development effects these migrations. We have not drafted or agreed upon any ordinances related to the facts. We just want to get the facts."

5. The new Environmental Initiatives Committee is developing new ordinances requiring solar panels and/or energy efficient design features to be implemented on homes with over 6,000 sq. ft. of floor area.  The committee presented its initial recommendations on September 15th, but the Council, after 2 hours of discussion and public input, decided to postpone their decision on the committee's proposal for 1 month.

Craig Jones (Councilmember) Response:

"While Breen Kerr has been the leader on this issue, the idea of creating the EIC was mine. I felt it was good planning to follow the LAH tradition of volunteer committees vetting policy choices prior to bringing them to the CC. The EIC is indeed recommending an ordinance, and we have been trying to get as many residents as possible to our meeting this Thursday (9/15) including the postcard announcement we mailed out to all residents. We appreciate you getting the word out as well. The recommended ordinance is not a solar mandate for all residents, but is instead an electrical energy conservation program for large new home construction (such as the one I am building). I am interested to hear residents' views on this new idea."

6. A new Ad Hoc committee (composed of Councilmembers Jean Mordo and Dean Warshawsky and Planning Commissioners Bart Carey and Eric Clow) is developing proposals for more restrictive ordinances regarding fencing and highly visible homes, including only allowing open fencing up to 4-1/2' high in areas with slopes over 30%.

Craig Jones (Councilmember) Response:

"I raised these issues at our (public) strategic planning meeting and the Ad Hoc committee is looking into these issues. I expressed the notion that certainty of meaning was important to residents trying to develop their property. I took from the Alon home case that a resident should be able to know, in advance, if they are on a "highly visible" lot and not leave it as a weapon to be used by neighbors that do not like the otherwise compliant home. I have no visibility as to the work of the Ad Hoc Committee, but when its recommendations come back to the CC, you can be sure there will be well publicized public hearings before any action is taken. This City Council is respectful of private property rights and has shown that we try to achieve noble goals with a practical eye towards the burden it places on homeowners. I think the way the CC handled the Pathways issue is an example of this."

Eric Clow (Vice Chair-Ad Hoc Planning Committee Member) Response:

"Several residents (and one ex-Mayor) saw my name as a member of the Ad Hoc Planning Committee in your recent alert and made the assumption that I supported the changes (30% slope and 4 1/2 feet) that were being proposed by a majority of the committee members at that time. They did not know that I had opposed these changes. In fact, with the help of two other members of the Planning Commission after the draft ordinance got its initial review, we were successful in removing them from the draft that will be sent to the Planning Commission for adoption and submission to the Council. The current version of the fence ordinance does not include the controversial mention of 30% slopes and open space fences remain at 6 feet maximum as under the current ordinance."

7. The Town is developing a joint plan with VTA (Valley Transportation Authority) to spend $1M to construct a roadside pathway along El Monte/Moody Road, which would include restricting traffic flow to 1 lane in each direction between 280 freeway and Foothill College.

Craig Jones (Councilmember) Response:

"What we are working on so far is the stretch west of here which is dangerous and needs a pathway. This would not involve narrowing the number of lanes. The stretch you are referring to here is also being looked at by traffic engineers, but has not come back to CC yet. We are just trying to prevent accidents here. "

The Town has not yet notified LAH residents of these impending changes via Town-wide mailings.

"We have widely publicized the first of these to come before the CC, the EIC recommended ordinance. The public school issue was widely written about in the latest Town Newsletter. As these subjects come to the CC for decisions, we will publicize them and where appropriate (as they would be on almost all these issues) conduct public hearings."

The Council feels our silence implies agreement with their plans.

"Since we have not adopted "plans" on any of these issues yet, I am not sure what you would be agreeing to or not. We want input and in fact are already getting it on those issues that are maturing to the point of a decision."

May 13, 2002 (Home Burglaries)

Below is email from one of our members who was burglarized on May 4th. Please protect your home, family and valuables by making sure that your windows and doors are locked. Notify the Sheriff's department if you observe any suspicious characters or witness a burglary.

I am a resident of Berry Hill Court. My residence was burglarized on Saturday May 4th evening at around 9 PM. My family and I believe that we were at home at that time and the break in occurred by forced entry (shattering the hinge on a double hung door in the master bedroom). Since our house is a ranch style home, we were on one side of the home and the burglary was executed on the other side. The alarm was not yet on as it was still early in the evening. All jewelry in the master bed room area (only jewelry) was taken. The perpetrators left behind not even a hint that the burglary had taken place.

Since this event I have learned that there has been very similar incidents just before and after our episode (totaling six). In all cases the mode of operation has been identical. The police officer who came was nonchalant; nothing has been done since the first report. I called the town hall telling them that the community should be alerted to this problem, but I have had no response so far. Had we known that there was this potential problem in the neighborhood, we may have been able to prevent this event. Just turning on the alarm even while one is at home ( as we are doing now) can become a great deterrent here. I am writing this email so that proper alerts can go out to your members. Luckily there has been no physical harm to anybody in the community. I hope that we can take action before that luck runs out.

Thursday, June 6th Off-Road Pathway Public Hearing

On May 31st the Los Altos/Los Altos Hills Chamber of Commerce's will Host its Salute to the Mayors Banquet.

Los Altos Hills Mayor Toni Casey will be honored on May 31st at the Crowne Plaza Cabana, 4290 El Camino Real, Los Altos, CA. (cocktails at 6:30 PM, dinner at 7:30 PM, $70 per person). Please RSVP by May 24th to the Los Altos Chamber of Commerce or contact Pat Dowd (650-941-7222) for more information.

On June 6 the City Council addresses the controversial Off-Road Pathway Easements in a Public Hearing. Your voice is very critical to a resolution that protects the safety and privacy of resident's property.

The LAH City Council will hold a public hearing on June 6th a t the Beth Am-Reform Congregation, 26790 Arastradero Road, Los Altos Hills, at 6:30 PM, to hear from residents regarding the update of the l981 Off-Road Pathway Plan. Off-road Pathways run in side or back yards of residents. The Council will hear from the public on whether to retain current off-road pathway easements that have no paths and whether to make future off-road pathway easements voluntary. Existing off-road pathways that have already been constructed will be retained.

In mid May, the Town will be mailing out a copy of the latest pathway plan which will be accepted in whole or in part by the Council at the June 6th meeting. Be sure and review the map in your area to see if your property has an off road pathway easement so that you can voice your opinion.

Please plan on attending these important events.

March 9, 2002 (Volunteers Needed)

TOWN OF LOS ALTOS HILLS

Community volunteers are needed for the following openings:

-Town Standing Committees (Four Year Terms)

*Emergency Communications- Committee membership consists of eight to twelve members; all of whom are either licensed ham radio operators or individuals in training for said licensed status. The Committee provides emergency radio communications services between the Town's Emergency Operations Center using ham radio frequencies and the County Office of Emergency Services and other facilities and agencies; participates in regular simulated disaster drills; provides occasional non-emergency communications for other sanctioned groups; develops and trains "associate" ham operators within the Town and maintains and updates the group's radio equipment. Meetings are held at pm on the fourth Tuesday of the month at 5pm in the City Council Chambers or Heritage House.

*Environmental Design and Protection- Consisting of eight members including some professionals in the fields of landscape design, environmental science and pollution control, the Committee assists with the implementation of the Town's landscape policy at subdivision, site development, Planning Commission and City Council meetings. Members also review and inspect plantings, study and make recommendations relating to landscaping and protection of public property, identify nuisance problems and sources of pollution and prepare educational materials for residents on landscaping and environmental protection. Meetings are held at 7:30pm on the second Tuesday of each month in the City Council Chambers.

*Pathways- Consisting of nine members, at least three of which bicycle regularly, this Committee reviews and recommends changes to the Town's Master Path and Bicycle Plans, advises on development- related pathway easement requirements and gives inp ut on pathway activities, sightings, priorities and maintenance. The Committee also studies and recommends pathway capital budget allocations and publicly promotes the pathway system as requested. Meetings are held at 7:00pm on the fourth Monday of the month in the City Council Chambers.

*Parks and Recreation- The membership of this Committee consists of a minimum of three members and a maximum of nine members including residents who are parents of young children. The Committee develops recreational programs, studies and makes recommendations on recreational facilities and works with the Westwind Barn Board to develop recreational opportunities at Westwind Barn and Byrne Preserve. Meetings are held at 9:30am on the third Monday of the month in the City Council Chambers.

*Information and Safety- There are eight members on the Committee. Their duties include studying and making recommendations regarding the safety and well-being of Town residents, coordinating safety activities within the Town, studying regional agencies emergency management systems and making recommendations concerning the Town's Disaster Plan and educating the public on their role in improving safety and preparing for emergencies. The Committee is also responsible for creating and updating long-range plans for improving technology for communication with citizens, identifying costs and funding resources for technology improvements and interfacing with the committee on cable TV, PG & E, water and phone services.

LAHCA Alert

Liz Cloutman at the Los Altos Town Crier is doing an article on the Los Altos Hills Pathway system and is asking for resident input. Here is the email message from her requesting inputs: "I am writing a pathways cover story and would like residents to share their opinions on and experiences with the pathways system and required easements as it stands now? I'd be glad to hear from them. I won't be able to include everyone in my cover story, but their opinions can help me in future stories as well and I'll have a way to contact them again as needed. In talking to people and attending planning commission and council meetings, there seems to be a fair confusion, anger and frustration out there on all sides. I hope I'll be able to get some useful information that will be helpful for everyone. If they could send an email to me as soon as possible, as I'm on deadline, I'd appreciate it."

November 17, 2001 (Home Burglary)

On Monday evening (11/12/01), sometime between 6 and 8 PM, the home of Wilf and Sigrun Corrigan on Normandy Lane in Los Altos Hills was burglarized. The burglar entered the home through a rear unlocked door and stole jewelry and purse, leaving the credit cards. The Sheriff's department have not yet apprehended any suspects, as far as we know.

Please take extra precautions to protect your homes and report any suspicious characters to the Sheriff's department. Also, if you have any information regarding the burglary on Normandy Lane, please report it to the Sheriff's department, as well.

November 1, 2001 (Afghan Children's Fund)

Mayor Toni Casey made a request at the last City Council meeting that each child in Los Altos Hills donate $1 to the Afghan Childrens' fund, following a request made by President Bush on October 11th. Money collected in this fund will support relief efforts for Afghan children. Checks should be made out to "America's Fund for Afghan Children" and sent to: Town of Los Altos Hills C/O Pat Dowd, City Clerk 26379 Fremont Road Los Altos Hills, CA 94022

There is no deadline for accepting donations. As the Town receives the donations, they will batch them up and send them on to the White House. A spontaneous gathering of those residents who can attend will occur at the corner of State and Main street at the Walter Singer Plaza at 7:00 P.M. in Los Altos to light our candles in support of President Bush and for the families and friends of loved ones who lost their lives.

We will also have a moment of silence and a silent moment of prayer for this enormous loss of life in such a senseless and tragic moment in our history.

On June 21st Mayor Steve Finn and the Los Altos Hills City Council will pass the gavel to Mayor pro-tem Toni Casey as the new Mayor. This will mark the third term for Toni Casey to serve our town as Mayor!

Please come to Town Hall (located at 26379 Fremont Road) at 5:45 P.M. on Thursday, June 21st to witness and celebrate this grand occasion, as well as to thank Mayor Steve Finn for his extraordinarily successful leadership over the past year! Our new Mayor Toni Casey will be announcing and submitting her 2001-02 goals and objectives to the Council for their approval.

May 20, 2001 (Town-Wide Survey Results)

The results of the recent Los Altos Hills Town-Wide survey are now available on the LAHCA web site at www.lahca.com. 1145 surveys were returned out of about 3500 households (an excellent 33% return rate). The City Council will use the results of this survey to develop the revised Land Use element of the Town's General Plan.

The Town Council and Planning Commission held a special joint meeting on November 18, 1999 at 6 P.M. during which the Color Board, Design Guidelines, and the Fast Track planning process were discussed.  The Council directed Planning to write up a proposal with various options for eliminating or minimizing the use of the color board, but left the present Design Guidelines in place until after the 1-year Fast Track trial period is over.

On September 16, 1999, the LAH City Council held a public meeting to consider comments regarding the Town’s requirements for limiting the exterior color of new homes and roofs. The discussion was continued to a later date, with no decisions being made, so that Town staff could provide the Council with examples of colors in the 40-60 Light Reflectivity range, for their review.

The Fast Track ordinance (Second Reading) was approved and is now implemented. Several homes have already gone through this streamlined approval process.
